Article 1. Membership & Visits

Section 1.0 Definition of Terms

Section 1.1 LeftFoot Coaching Services

LeftFoot Coaching, LLC, henceforth known as “LeftFoot” provides coaching services to players between the ages of 8 and 26 for the purpose of supplementing their youth soccer technical skill development. Since players under the age of 18 are legally bound to the parent and/or guardian, both the player and the parent are referred to as the “the Client” in these Terms and Conditions of LeftFoot Coaching Services, hence forth “Terms and Conditions.”

Section 2.0 Delivery of Services

Section 2.1 Delivery of Services: Classes

LeftFoot provides a model of delivering services through the use of Classes that are provided on a fixed yet seasonal rhythm consistent with the experience and expertise of the coaching philosophy. In no way are the rhythms of the seasonal offerings consistent month to month or day to day, but every effort is made to provide maximum access, opportunity and flexibility for the Client to schedule and attend these classes.

Classes can be distributed on the schedule with a variety of terminology and variations: Academy Series, Semi-Private Coaching, and Funky Old LeftFoot to name a few. Classes can vary in time duration, enrollments offered, date of service, and time slot. LeftFoot reserves the right to vary class duration, days, times, and enrollments in accordance with it’s seasonal rhythms.

Section 2.2  Delivery of Services: Courses

A course is defined as a coaching service with a set period of time, dates, length of service, months and enrollment options that restrict the use of rescheduling, cancellation and drop in enrollment. A course can be used in the manner of a service delivered to the client in the form of a program, camp, extended training and/or pre-programmed, reserved coaching service and education. The Client is reserving the rights and privileges of receiving coaching services at a facility with fixed costs and reservation of staff with no guarantee of service based on non-attendance. The Client understands that courses are different than classes and do not perform under the same rescheduling options as passes and plan as defined in Article 5 - Passes and Plans.

Section 2.3 Delivery of Services: Appointments

Appointments refer to the random scheduling and availability of the coach and the client. The Client has opportunities to schedule a random time slot with a specific coach when the coach sets their time as “available”. These appointments are the responsibility of the Client to attend, book, and complete payment. Requests for time slots can be made, but are not the responsibility of LeftFoot to offer outside of its prescribed time slots. Appointments are typically one to one service delivery: for coaching guidance, One on One Coaching, interviews and player development.

Section 3.0 Use of Services

Section 3.1 Definition of Use of Services

For the purpose of delivering coaching services, LeftFoot utilizes a discounted coupon which guarantees a low priced value that can be exchanged for services by the means of attending LeftFoot Coaching Academy classes.  These coupons, hereby referred to as “sessions,  allow "the Client”  to schedule, reschedule, reserve, and exchange value relative to seasonal rates in exchange for a specific service exchange and are based on the timelines and terms of expiration for the use of these discounted coupons. These “sessions” expire based on the terms defined in the passes and plans, Article 5 - Passes and Plans. Sessions have a variety of rescheduling options based on the terms and descriptions listed in Article 5 - Passes and Plans and are not consistent terms of expiration.

Section 3.2 Use of Services: Single Visits

Single Visits are made available to the Client to random purchase at their desire for a one-year expiration and exclusion of use based on seasonal programming. Single Visits can only be used by the Client for classes. No Single Visits can be used for courses. The Client has the choice to purchase a full priced Single Visit instead of discounted coupons referred to as sessions.

Section 3.3 Use of Services: Passes

LeftFoot provides passes to its clients that are based on expiration dates and bundles of discounted coupons that can be exchanged for coaching services. These multi-session coupons are to be exchanged for coaching services purchased by the client online and have various expiration dates described in the offering. The following sections outline the differences in expiration dates and trimesters for the use of various passes.

Section 3.3.1 Use of Service: Passes - Definition of Pass

A pass is anything considered to be purchased on a one time basis for a set period of time, in either one month, three month, or weekly intervals.These expiration dates allow LeftFoot to set different prices throughout the year which may be higher or lower than a Single Visit and/or Student Tuition Plans. A full description of Passes are listed in Article 5 - Section 2.

Section 3.3.2 Use of Service: Passes - Definition of LeftFoot Client-Pass

The LeftFoot Client-Pass is a 3 month expiration from the date of purchase by the Client offered to the general public and LeftFoot6 - All Ways a Leftie members.

Section 3.3.3 Use of Service: Passes - Definition of LeftFoot Fast-Pass

A LeftFoot Fast-Pass is a 1 month from the date of purchase pass for either 4, 8 or 12 sessions exclusive to LeftFoot Members on Student Tuition Plans. 

Section 3.4 Use of Services: Plans

LeftFoot provides plans to its clients that are based on expiration dates and discounted coupons that can be exchanged for coaching services. These coupons are to be exchanged for coaching services which are purchased by the client and have various expiration dates. The following sections outline the differences in expiration dates and trimesters for the use of various plans. A plan is any type of recurring reservation or distribution of session coupons on a specific time allocation. Three types of Plans are used at LeftFoot Coaching Academy: Payment Plans, Reserve Plans, and Student Tuition Plans.

Section 3.4.1 - Use of Service: Plans - Payment Plans

A Payment Plan is used for the payment of series provided in a Student Tuition Plan or the LeftFoot Privado™

Section 3.4.2 - Use of Service: Plans - Reserve Plans

A Reserve Plan, is used for 5, 7, 8, 10 or 14 week reservation sessions per term. These can be reserved by any member in good standing within the Academy based on the Academy Trimesters and Terms. Reserve Plans are only offered during certain periods of time and cannot be replaced or substituted. Reserve Plans are used for the following services or programs: Semi-Private Coaching, Academy Series, and the LeftFoot Privado™. LeftFoot reserves the right to restrict the use of Reserve Plans for the season, trimester, and term of service duration.

Section 3.4.3  Use of Service: Plans - Student Tuition Plan

A Student Tuition Plan is 16 or more sessions over the course of the year. Plans allow LeftFoot to guarantee visits which are reserved and sold within the Academy for either a random or fixed schedule.

Section 3.5. Use of Service - Coupons

Unless otherwise stated on the Coupon or required by law, the following additional terms apply to all Coupons

Coupons (i) have no cash value, (ii) are not redeemable for cash. Coupons are only good for a single transaction; any remaining amount is not exchangeable with cash or another voucher and will be forfeited. Coupons may only be redeemed on summer programming and may not be used for monthly tuition. LeftFoot is in no way responsible for unused coupons issued to your account.  Coupons expire on September 1st of the year issued.  Possession of a LeftFoot coupon does not guarantee enrollment in a particular summer session.  The session must have availability.  All Session Terms and Conditions apply to any Summer Program redeemed with a LeftFoot Coupon.

Section 4.0 LeftFoot Annual Membership

Section 4.1 Description of LeftFoot Annual Membership

The Client has the opportunity to be offered an Annual Membership that provides coaching services exclusive to LeftFoot and the relationship with the Client for player development. The Membership is offered to outstanding applicants that receive privileges to purchase, reserve, and gain exclusive services not offered to the general public.

  • Priority Access to LeftFoot sessions and services.
  • Member Guidance Development Calls- also known as North Star Alignment Coaching
  • Tutorials on LeftFoot skills and player development

Section 4.2 Cancellation and Renewal of LeftFoot Annual Membership

There is no automatic renewal for this membership fee and it cannot be extended, exchanged, or refunded once the purchase has been made. Each year the Client must provide written confirmation to renew and/or submit payment to confirm enrollment in LeftFoot Coaching Academy.

Section 5.0 LeftFoot6 All Ways a Leftie Membership

Section 5.1 Description of LeftFoot6 All Ways a Leftie Membership

The LeftFoot6 - All Ways a Leftie Membership covers the first year and second year of participation with an automatic renewal. After the second year of renewal The Client has full rights to participate in the Academy without a Tuition Plan and may purchase coaching services “a la carte”.

Section 5.2 Cancellation and Renewal of LeftFoot Annual Membership

All LeftFoot6 All Ways a Leftie Memberships will be canceled at the end of their current contracted year. No automatic renewals will be processed after February 15th, 2017. Once the contracted year of the LeftFoot6 All Ways a Leftie Membership is completed, The Client will need to purchase LeftFoot 2017 Membership in order to continue participating as a Member.

 

Article 2. Assumption of Risk

Section 1.0 Assumption of Risk

The Client assumes all risk inherent in purchasing an allocation of discounted session coupons as defined in Article 1. Section 3.1, 3.3 & Section 3.4. for the Terms and Conditions of LeftFoot Coaching Services. The Client also agrees that the inability to schedule such services in a time slot specific to the Client is outside of the domain of LeftFoot’s Description of Services in these Terms & Conditions. LeftFoot and its partners under no circumstances guarantee specific daily attendance, time slot availability and/or seasonal openings within the Terms and Conditions of LeftFoot Coaching Services. The Use of Coaching Services only guarantees a specific price per session as a coupon assuming the coupon is fully used within the terms set forth in the expiration date and agreed upon during the purchase by the client.  The option to reschedule and cancel up to 24 hours prior to the start of the session, as well as the random flexibility is part of the necessary expiration deadline required to maintain a fixed enrollment within a session.

The Parent, The Client, and/or scheduling agent of the player assumes all risk inherent in the technology, mobile applications, driving capacity, weather, unforeseen consequences and availability of scheduled sessions based on the timing of the scheduler. While sessions are prepared in advance and allocated to the Front Desk service system at a minimum of two months, LeftFoot Coaching, LLC and its partners are not liable for user error, scheduling challenges with the Clients’ club soccer schedule, and/or additional activities inherent in youth sports and planning for families.

Section 2.0. Non-Attendance

The Client that chooses not to attend the LeftFoot Coaching Academy sessions for any reason including but not limited to injury, sickness, vacations, spring/winter break, trips, tournaments, games, practices, family camps and/or school will not be exempt from cancelation fees or expiration dates related to any of Terms and Conditions of LeftFoot Coaching Services including but not limited to Courses, Programs, Classes, Appointments, Plans, Passes or Single Visits. LeftFoot Coaching, LLC is not selling “attendance of sessions/services” with the Terms and Conditions of LeftFoot Coaching Services, only discounted coupons that can be exchanged for services at the time of enrollment on the day of service. 

 

Article 3. Academy Trial Application

Section 1.0 Description & Requirements of the Academy Trial Application

The Academy Trial Application gives the prospective client access to schedule and attend up to 4 sessions within 35 days of the purchase date and notification by use of a Trial: “Client Pass”. This Trial Application Consideration is a required prospective enrollment package. This allows prospective and returning students of LeftFoot Coaching Academy the necessary evaluation of techniques, coaching and membership interviews regarding the  progressions of skills which are required for membership and instruction in the LeftFoot Coaching model.  Trial Application Consideration is required for any student more than six months removed from an active Membership or Tuition Plan.

Academy Sessions, or Passes, issued during the Trial Application expire at the end of the 35 day time period once notification of package setup is sent and are thus forfeit upon any non-attendance, cancellation, sickness, injury, vacation, weather, or time is considered. Unused sessions are forfeited and cannot and will not be extended, exchanged, refunded or credited upon submission of the Terms of Purchase agreed upon by the client at the time of online purchase. Trial Applicants are required to schedule two interviews for consideration into Membership:

  1. Trial: Coaching Call Interview 
  2. Trial: Membership Interview

These are required to be scheduled by the client within three weeks of purchase and cannot be refunded, exchanged, credited or rescheduled without purchase if the client no-shows, or declines these interview calls within the time period of the Application Consideration. Refer to Definition of Appointments in Article 1 - Section 2.

Section 2.0 Conditions of Use for the Academy Trial Application

Trial Applications are designed to test the applicants’ commitment and ability to schedule within a short period of time. Failure to schedule all sessions, coaching and membership interviews justify denial of membership as grounds for not meeting the terms and conditions for membership upon a year-long commitment under Article 1 - Section 5. No exceptions, refunds, reschedules, extensions or combination with other offers are allowed. Invitations to Membership are sent upon a minimum of three (3) Trial sessions completed and both interviews conducted and approved. Academy Trial Applicants agree to these Terms and Conditions of LeftFoot Coaching Services upon purchasing the Academy Trial Application.

Section 3.0 Denial of Membership with the LeftFoot Coaching Academy Trial Application

LeftFoot deserves the right to refuse Trial Applications based on internal recipes of success based on both the coaching interview and the membership interview. Denial of Membership can be related to parenting values, player behavior during sessions, learning styles, motivation of the parent and/or child as well as travel, time commitments and preference of students that represent the values of LeftFoot Coaching Academy. Trial Applications that are refused Membership can re-apply after a Six Month wait period. 

Section 4.0 LeftFoot Academy Orientation   

If you need to cancel or reschedule, a 72 hour notice is required. You can reschedule into another Orientation date if we have space. If you late cancel within 24 hours before your Orientation time, there will be no refund and you will have to purchase another Orientation time. If there is no space or no other dates that work for you, then you will have to wait until November to purchase a Trial. If you cannot attend your Orientation date and give no notice, you will not be invited into Trial and won't be eligible until a November Trial window opens up.

 

Article 4. Student Tuition Plans

Section 1.0 Description of LeftFoot 2017 Student Tuition Plan Services

Student Tuition Plans guarantee low priced discounted coupons that can be exchanged for services by the means of attending LeftFoot Coaching Academy sessions.  These“sessions” are distributed to "the Client", in exchange for a 12 month contract for services at a fixed annual price paid through an 8 month payment plan. The Client agrees to pay eight equal payments for the total cost of the Student Tuition Plan, billed on the first month of the contract in order to receive these coupons and sessions at the designated price.  Final payment will be made in the 8th month of the contract.

The Student Tuition Plan runs for 12 calendar months from the prescribed date of enrollment with another coupon issued to exchange for summer programing which will be utilized during the months June through August, or referred to as Summer Programs.

Section 2.0 Requirements of LeftFoot 2017 Membership with Student Tuition Plan

The Client commits to a 12 month contract for services under the Student Tuition Plan for the first year of enrollment in Youth, Junior and/or Senior Academy. Thereby, for each “first year” in any sub-Academy, the client agrees to enrollment in a Student Tuition Plan to facilitate the necessary development of the player and guarantee space for the student as they enroll in the next sub-Academy. The Client has the option during their Trial Membership Interview or Membership Guidance Call to reserve the LeftFoot Membership with the following services :

  • LeftFoot 2017 Membership and Tuition Plan
  • LeftFoot 2017 Membership and Summer Program

All Tuition Plans require an active LeftFoot 2017 Membership within 30 days of enrollment and participation.

Section 3.0 Enrollment Dates for the LeftFoot Student Tuition Plan

In order to receive consideration for the LeftFoot Student Tuition Plan, Enrollment Deadlines are managed to provide access to enrollment in a fixed schedule of services outlined in the LeftFoot 2017 Options and Pricing. Clients only receive discounted sessions through the Student Tuition Plan at a fixed fee by a specific date. Tuition Plan enrollment dates are January 1st, February 1st, August 1st and November 1st. After which the next enrollment period for which a student can receive consideration for a Tuition Reservation is two months prior to the Tuition Plan Enrollment Date:

  • Enrollment Date: January 1st; Applicant Consideration starts by November 1st.
  • Enrollment Date: February 1st; Applicant Consideration starts by December 1st.
  • Enrollment Date: August 1st;  Applicant Consideration starts by June 1st.
  • Enrollment Date: November 1st; Applicant Consideration starts by September 1st.

Note that the purchase of a Tuition Plan in no way guarantees a spot in a certain session, just the access for the client to schedule the sessions. If the client needs a specific reservation then a Reserve Plan is encouraged.

Section 4.0 Student Tuition Plan Session Expiration

Within the Student Tuition Plan the Client is receiving a discounted coupon for services, the Tuition Pass, defined in Article 5 - Section 2.3. The Tuition Pass expires within 60 days and/or two calendar months from date of issue depending on the schedule and length of the calendar month. All Student Tuition Plans are paid on the first of the month, all Tuition Passes are set to begin on the first of the month. Certain exceptions apply to shortened months and seasons. Check the Academy Calendar for exact dates of open service.

Section 5.0 Student Tuition Plans Distribution

Section 5.1 Tuition Plan Overview

An Overview of the Student Tuition Plans are as shown below in the Student Tuition Plan Distribution, the client agrees that the Terms and Condition of Use for Coaching Services and the Session Allocation is their sole responsibly to schedule, attend and reschedule. No Academy member, employee, or coach assumes any risk inherent in verbal or written communication related to scheduling Client services.

Section 6.0 Description of the Platinum Student Tuition Plan

  • Available for Youth Academy Students Only (U9-U12, aligned by birth year USSF 2017 mandate).
  • 45 sessions annually (30 sessions with a $485 Coupon towards Summer Programming).

  • 18 sessions annually (12 sessions with a $210 Coupon towards Summer Programming).

Section 10.0 Refunds and Cancellations of Student Tuition Plans

Your Student Tuition Plan cannot and will not be refunded under any circumstances, once you accept the purchase request, click to purchase and accept these Terms and Conditions for Service. The Client agrees to waive any Merchant Chargeback claims within the Terms and Conditions of the Student Tuitions Plan.  A 30 day grace period for cancelation of services, minus a $99 Processing Fee, will apply after accepting the request for injuries and household changes as outlined below, however it will not be guaranteed:

  • Change in income,
  • Change in living status
  • Change in health
  • Unforeseen circumstances for the family.

A cancelation fee will apply to cancellation of the Student Tuition Plan if terminated by the Client prior to the 8th*** calendar month unless detailed below.

The Client may cancel a Student Tuition Plan during the Academic year with several conditions listed in the Refunds and Cancelations section outlined below. Be sure to understand that you are agreeing to a 12 month contract for services with a lower price per session and that these conditions apply to all Tuition Plans under LeftFoot 2017 as of January 1st, 2017.

If for any reason, the Client needs to change or cancel the Student Tuition Plan, they must provide a written cancelation notice and our policies are outline below.

Section 10.1 Cancelation Within 3 Days of Purchase or Enrollment

LeftFoot Enterprises LLC. and its partners will waive all Cancelation Fees, refund The Client within 10 business days and thereby immediately cancel the Student Tuition Plan provided that no services are rendered including that The Client has not scheduled for service delivery.

Section 10.2 Cancelation After 3 Days but Prior to 5 Months of Purchase or Enrollment

The Client waives all rights and privileges related to delivery of services when they request to cancel a Student Tuition Plan. This means that no remaining sessions, planned attendance, or services to be rendered will be serviced. A Cancellation Fee of 25% of the remaining Contract Term of the Student Tuition Plan will be charged to the card on file. Refer to Section 3.5 for the total cost of all Student Tuition Plans. Payments made prior to the written cancellation notice will be refunded if higher than 25%. 

Section 10.3 Cancelation After 5 Months

The Client waives all rights and privileges related to delivery of services when they request to cancel a Student Tuition Plan. after 5 months but prior to 8 Months of Purchase or Enrollment. This means that no remaining sessions, planned attendance, or services to be rendered will be serviced. A Cancellation Fee of 20% of the remaining Contract Term of the Student Tuition Plan will be charged to the card on file. Refer to Section 3.5 for the total cost of all Student Tuition Plans. Payments made prior to the written cancellation notice will be refunded.

Section 10.4 Cancelation After 8 Months

If all payments for the total cost of the Student Tuition Plan has been paid by the customer, they are free to cancel at anytime without a Cancelation Fee if they choose to cancel the Student Tuition Plan after 8 months but Prior to 8 Months of Purchase or Enrollment. However, if the customer wishes to cancel their Student Tuition Plan, they forfeit the right to use any sessions associated with the Tuition Plan after written notification of cancelation has been provided.

Section 11.0 Temporary Suspension of Student Tuition Plans

LeftFoot is unable to temporary suspend a Tuition Plan and then resume it at a later date due to schedule and coaching resource planning.

Section 12.0 Switching Student Tuition Plans

Tuition Plans are aligned to the birth year of the student and are a year-long contract. Tuition Plans can only be switched at the start of a new 12 month contract.

 

Article 5. Passes & Plans

Section 1.0 Definition of LeftFoot Passes & Plans

LeftFoot Coaching Academy provides both passes and plans to its clients that are based on expiration dates and discounted coupons that can be exchanged for coaching services. These coupons to be exchanged for coaching services are purchased by the client and have various expiration dates. The following sections outline the differences in expiration dates and trimesters for the use of various passes and plans.

A pass is anything considered to be purchased on a one time basis for a set period of time. For instance, a LeftFoot Client-Pass is a 3 month expiration from the date of purchase by the Client. A LeftFoot Fast-Pass is a 1 month from the date of purchase pass for either 4, 8 or 12 sessions. These expiration dates allow LeftFoot to set different prices throughout the year which may be higher or lower than a Single Visit and/or Student Tuition Plans.

A plan is any type of recurring reservation or distribution of session coupons on a specific time allocation. Two types of Plans are used at LeftFoot Coaching Academy. A Reserve Plan, which is used for 5, 7, 8 or 14 week reservation sessions per term, these can be reserved by any member in good standing within the Academy based on the Academy Trimesters and Terms. Reserve Plans are only offered during certain periods of time and cannot be replaced or substituted.  A Student Tuition Plan is 16 or more sessions over the course of the year. Plans allow LeftFoot to guarantee visits which are reserved and sold within the Academy for either a random or fixed schedule. Discounts can be given for fixed scheduling within specific time frames each term since the expiration date of the session is fixed at one week.

Section 2.0 LeftFoot Passes

The LeftFoot “Client-Pass” allow the player, parent, and family, hereinafter referred to as, "the Client", a block of sessions at particular price discounts that expire within a designated amount of time. The Client agrees to pay the cost of the LeftFoot “Client-Pass” upfront for access to the schedule the sessions/services.  For the purposes of planning, as well as the privilege of attending LeftFoot Coaching Academy, we offer the Client these lower priced sessions and guarantee to provide Access, Opportunity, and Flexibility for the client to schedule, reschedule, plan and have access to coaching services at LeftFoot Coaching Academy. In exchange, the Client agrees to schedule the sessions within the expiration framework of the LeftFoot “Client-Pass” and agrees that any unused services will not be refunded or extended.

By submitting payment to access a  LeftFoot “Client-Pass”  through the Front Desk service website, the client and user of the LeftFoot “Client-Pass” agree to the following:

The discounted price of the per-session fee entitles the Client use of a “coupon” to be exchanged for attendance at LeftFoot Coaching Academy. These “coupons” have no cash value, cannot be refunded, exchanged, extended or replaced for any other value than the use of the attendee for the Academy progressions that is designated at the time of purchase.  

The LeftFoot “Client-Pass” expires exactly Three Months from the date of purchase and cannot be extended, exchanged or refunded once a purchase has been made. Under no circumstances will you be entitled to a credit, cash refund, or other reimbursement for unused or  expired free sessions. 

No staff member can sell, send a purchase request or "apply" a LeftFoot "Client-Pass" to your account at any time and under no circumstances may a LeftFoot "Client-Pass" be applied to your account without your direct submission of payment through the Front Desk website. 

You agree that it is your sole responsibility to utilize the LeftFoot “Client-Pass” in the time and Terms and Conditions of Use and that no verbal agreement by any employee, agent or director of LeftFoot Coaching, LLC shall entitle you to any privileges or promises outside of these Terms and Conditions of Use.

The LeftFoot “Client-Pass” expires Three Months from the date of purchase based on the date of purchase and expiration timeframe and cannot be extended, exchanged or refunded once a purchase has been made. Under no circumstances will the Client be entitled to a credit, cash refund, or other reimbursement for unused or expired sessions.

Section 2.2.2 Refunds and Cancellations of the LeftFoot “Fast Pass”

The LeftFoot “Fast-Pass” expires THIRTY DAYS from the date of purchase based on the date of purchase and expiration timeframe and cannot be extended, exchanged or refunded once a purchase has been made. All LeftFoot “Fast-Pass” “coupons” shall expire and be deemed forfeited upon cancellation of your LeftFoot 2017 Membership or Student Tuition Plan. Under no circumstances will the Client be entitled to a credit, cash refund, or other reimbursement for unused or expired sessions.

Section 2.3 LeftFoot Student Tuition Passes

Section 2.3.1 Description of Student Tuition Passes

LeftFoot Student Tuition Passes are associated with the Student Tuition Plans. The Passes are responsible for allocating sessions based on the distribution for each plan option. Refer to Article 4 - Section 6.0 through Section 9.0 for more details regarding Student Tuition Plan Session Distribution.

Section 2.3.2 Refunds and Cancellations of Student Tuition Passes

Refer to Article 4 - Section 10.0 for information regarding Student Tuition Plan refunds and cancellations.

Section 2.4 Temporary Suspension of a LeftFoot Pass

LeftFoot Coaching, LLC is unable to temporary suspend any and all Passes, including the LeftFoot “Fast-Pass”, The LeftFoot “Client-Pass”, and the LeftFoot Tuition Pass as these “coupons” are priced to discount excess capacity during the moment that the price is offered. LeftFoot cannot under any circumstance suspend and then resume a pass at a later date due to schedule and coaching resource planning.

Section 2.5 Non-Attendance of a LeftFoot Pass, Sessions or Services

The Client that chooses not to attend the LeftFoot Coaching Academy sessions for any reason forfeits any and all claims for refunds, credits, exchanges, extensions and/or special consideration. LeftFoot Coaching, LLC is not selling “attendance of sessions/services” only Access to sessions/services. Under no circumstances will the Client be entitled to a credit, cash refund or other reimbursement for unused or expired sessions.

Section 2.6 Assumption of Risk for a LeftFoot Pass

The Client assumes all risk inherent in purchasing an allocation of sessions and the inability to schedule such services in a time slot specific to the Client. LeftFoot Coaching, LLC and its partners under no circumstances guarantee specific daily attendance, time slot availability and/or seasonal openings with the any and all Passes, including the LeftFoot “Fast-Pass”, The LeftFoot “Client-Pass”, and the LeftFoot “Tuition-Pass”. A LeftFoot Pass only guarantees a specific price per session attended and the option to reschedule and cancel up to 24 hours prior to the start of the session within a specific time frame. The parent and/or scheduling agent of the player assumes all risk inherent in the technology, mobile applications, and availability of scheduled sessions. While sessions are prepared in advance and allocated to the Front Desk service system, LeftFoot Coaching, LLC and its partners are not liable for user error, scheduling challenges with the Clients’ club soccer schedule, or additional activities inherent in youth sports.

Section 3.0 LeftFoot Plans

Section 3.1 The Reserve Plan

Section 3.1.1 Description of Semi-Private Coaching: Reserve Plan

The Semi-Private Coaching: Reserve Plan (SPC: Reserve Plan) is pre-paid reoccurring plan for once a week coupons. The SPC: Reserve Plan includes a pre-paid booking fee of $35 for enrolling the student in a set number of sessions with the set coach. This pre-paid booking fee is a service to the client to schedule the client into a specific class with the preferred coach. Clients are encouraged to cancel and notify the coach of non-attendance within 24 hours. If attendance is canceled with more than 24 hours of notice, the client may reschedule into any Semi-Private Coaching class within the same calendar week; this must be done by the client and if the client fails to do so, the class will not be put back onto the SPC: Reserve Plan. Any reschedules must be made in the student's designated Academy Level (Youth, Junior, Senior). The coach has the right to refuse services if the client enrolls in the wrong level of class.

This Plan is also associated with The LeftFoot Privado™, which is responsible for reserving and tracking all Semi-Private Coaching sessions associated with The LeftFoot Privado™. The following information are terms specific to the Semi-Private Coaching: Reserve Plan product.

Section 3.1.2 Description of Academy Series: Reserve Plan

The Academy Series: Reserve Plan (AS: Reserve Plan) is pre-paid reoccurring plan for once a week coupons. The AS: Reserve Plan includes a pre-paid booking fee of $35 for enrolling the student in a set number of sessions with the set coach. This pre-paid booking fee is a service to the client to schedule the client into a specific class with the preferred coach. Clients are encouraged to cancel and notify the coach of non-attendance within 24 hours. If attendance is canceled with more than 24 hours of notice, the client may reschedule into any Semi-Private Coaching class within the same calendar week; this must be done by the client and if the client fails to do so, the class will not be put back onto the AS: Reserve Plan. Any reschedules must be made in the student's designated Academy Level (Youth, Junior, Senior). The coach has the right to refuse services if the client enrolls in the wrong level of class.

Section 3.1.3 Refunds and Cancellations of The Reserve Plans

The Reserve Plans expire exactly at the end of the length of the term from the term start date based on the Academy trimester in which it was sold and cannot be extended, exchanged or refunded once a purchase has been made. All Reserve Plan “coupons” shall expire and be deemed forfeited upon cancellation of your LeftFoot Annual Membership. Under no circumstances will you be entitled to a credit, cash refund or other reimbursement for unused or expired sessions.

Section 3.1.4 Temporary Suspension of The Reserve Plans

LeftFoot Coaching, LLC is unable to temporary suspend Reserve Plan “coupons” and then resume it at a later date due to schedule and coaching resource planning.

Section 3.1.5 Non-Attendance of The Reserve Plans Sessions or Services

The discounted price of the per session fee entitles the customer use of a “pre-booked coupon” to be exchanged for attendance at LeftFoot Coaching Academy. These “coupons” have no cash value, cannot be refunded, exchanged, extended or replaced for any other value than the use of the attendee for the Academy progressions that are designated at the time of purchase and within the prescribed session with the prescribed coach. The Reserve Plans are an internal “coupon” which reserves only the session, time of day and coach. It cannot be rescheduled, exchanged, credited to the account or cancelled during the time of the reserved dates.

Section 3.1.6 Assumption of Risk for The Reserve Plans

No staff member can sell, send a purchase request or “apply” a Reserve Plan to your account at any time and under no circumstances may your student be enrolled into a session without your direct written request submitted through our ZenDesk support software or by means of a Reservation Form submitted by the client.

You agree that it is your sole responsibility to utilize the Reserve Plans in the time and dates of the written plan within the Terms and Conditions of Use and that no verbal agreement by any employee, agent or director of LeftFoot Coaching, LLC shall entitle you to any privileges or promises outside of these Terms and Conditions of Use.

Section 3.2 Payment Plans

Payment Plans do not directly provide services, but instead provide a structure for payments for The LeftFoot Privado™ and Student Tuition Plans. The do not directly allocate sessions. Failure to provide payment through Payment Plans will result in suspension of related services, sessions, passes, courses or programs.

Section 3.2.1 Description of The LeftFoot Privado™ Payment Plan

A Payment Plan is offered for The LeftFoot Privado™ which combines the cost for the One-on-One sessions as well as the Semi-Private Coaching: Reserve Plan and evenly distributes the cost into installments. For more information regarding The LeftFoot Privado™, refer to Article 6 - Section 3.2.

Section 3.2.2 Description of the Student Tuition Payment Plan

A Payment  Plan is offered for Student Tuition Plans which provides a fixed payment schedule for their Student Tuition Plan services. For more information please refer to Article 4 - Section 6.0 through 9.0.

 

Article 6. Programs & Courses

Section 1.0 Description of Programs and Courses

As defined in Article 1 - Section 1.2.2, Delivery of Services - Courses, LeftFoot offers seasonal programs and courses to benefit the Client which streamline coaching services. The following section defines the programs and courses, henceforth referred to as “Program(s)”.

Section 2.0 Program & Course Names and Variety

The following Programs are referred to under the delivery of services related to Programs and Courses:

  • LeftFoot Coaching Academy - Accelerator
  • The LeftFoot Privado™
  • The LeftFoot BootCamp
  • LeftFoot Dynamic Training
  • LeftFoot Fantastic Finishing
  • The LeftFoot Intensive

It is assumed and understood that LeftFoot Programs & Courses have customer segments and descriptions of the courses in marketing and coaching service descriptions that may vary. For instance, The LeftFoot BootCamp can be listed as Junior Academy BootCamp, or LeftFoot BootCamp - Junior Academy. Variations in name and titles are combined in this definition of service and the Program & Course Names and Variety.

Section 3.0 General Description of Programs and Courses

Section 3.1 Delivery of Services: Course - Accelerator

An Accelerator is defined as a one week camp for 1.5 hours or more. Accelerators can typically run between 9am-11pm Monday - Thursday or 1-3 pm Monday - Thursday. Accelerators can also be Weekend workshops for 2 hours or more than 2 weekends. Accelerators can be topic related, segmented through Academy Levels and can be referred to in a variety of naming conventions, particularly in the following fashion: [Academy -Topic  - Accelerator ] — (i.e, Junior Academy Deadly BallStriking Accelerator, Great Player Series Accelerator, FootSkills Accelerator.)

The absence of topics or academy levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions..

Section 3.2 Delivery of Services : Course - The LeftFoot Privado™

The LeftFoot Privado™ is a 75 minute bundled course consisting of a 30 minute on-on-one and a 45 minute Semi-Private Coaching Session (SPC) that runs the same day, at the same time, with the same coach. The LeftFoot Privado™ takes special use of The SPC Reserve Plan for the client to reschedule the Semi-Private Coaching services within the week. Please refer to Section 1.2.3 for Conditions. The LeftFoot Privado™ can vary in price, time-slot, seasonality, and options based on the season. Participants in the LeftFoot Privado™ must be LeftFoot 2017 Members.

The absence of topics or academy levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions.

Section 3.2.1 Coach Cancelation of The LeftFoot Privado™ Sessions or Services

If your coach is the one who cancels your session -the coach will be required to reschedule a replacement coach to avoid additional facility rentals for your One on One session. If you deny a replacement coach, but want to reschedule the coach within the LeftFoot Soccer Academy, you may be required to pay additional fees for the rental of the field space. Talk to your coach to figure out a make-up One-on-One time that works and schedule your missed Semi-Private Coaching session. The coach is not required to reschedule your Semi-Private Coaching session. 

Section 3.2.2 Non-Attendance of The LeftFoot Privado™ Sessions or Services

The Client that chooses not to attend the LeftFoot Coaching Academy Semi-Private Coaching (SPC) session for any reason is forfeit upon the day or scheduled service. LeftFoot Coaching, LLC is not selling “attendance of sessions/services” only reservations to sessions/services. Under no circumstances will you be entitled to a credit, cash refund or other reimbursement for missed sessions.

If you cannot make it to one of your weekly sessions due to a vacation, illness, previous commitment, sport competition, etc... you can reschedule the Semi-Private Coaching (SPC) session for a different time the same week. If you do not reschedule your missed Semi-Private Coaching class, within the time period you will not  be entitled to a credit, cash refund or other reimbursement for the missed session.  Your One-on-One session for the week will be forfeit. Refer to Article 5, Section 3.1 for more information.

Section 3.3 Delivery of Services: Course - The LeftFoot BootCamp™

The LeftFoot BootCamp(BD) is a 1.5 hour course in the mornings, typically only in the summer with 16-24 enrollee’s. The LeftFoot BootCamp can be named in a variety of manners, along the lines of Junior Academy BootCamp, Senior Academy BootCamp or The LeftFoot BootCamp - Senior Academy.

The absence of topics or Academy Levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions.

Section 3.4 Delivery of Services: Course - Dynamic Training

LeftFoot Dynamic Training (DT) is a course that offered in the winter and summer months for the use of maximum enrollments of 16 through 24 with multiple instructors. During the winter and summer programming cycles, Dynamic Training is offered as an enrollment course pre-booked and restricted to a set number of players and coaches.

The absence of topics or academy levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions.

Section 3.5 Delivery of Services: Course - Fantastic Finishing

Fantastic Finishing (FF) is a course that is offered for 6-8 players during the summer months and over the weekends through the winter. The Fantastic Finishing can be named in a variety of manners, along the lines of Junior Academy Fantastic Finishing, Senior Academy Fantastic Finishing or Fantastic Finishing - Senior Academy.

The absence of topics or academy levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions.

Section 3.6 Delivery of Services: Course - Intensive

The LeftFoot Intensive is a 2 week course

  • June Performance Prep™
  • July Tryout Prep™

Section 3.6 Delivery of Services: Program - MasterMind

The LeftFoot MasterMInd program is offered for 6-10 players during the summer months, and combines One on One Coaching, Group Sessions, a Game Visit, and weekly check-ins. Each one of these components can be named in a variety of manners and variations, such as MasterMind: One on One Coaching.

The absence of topics or academy levels are the purview of LeftFoot. LeftFoot reserves the right to modify, elaborate and change the how the program appears in marketing, finance, invoices, catalogs, web and scheduling services but assumes protection under these Delivery of Services definitions.

Section 4.0 Refunds and Cancelations of Programs and Courses

The Programs and Courses cannot be extended, exchanged or refunded once a purchase has been made. Under no circumstances will you be entitled to a credit, cash refund, or other reimbursement for unused or expired course attendance as defined in Article 2 - Assumption of Risk.

Section 5.0 Temporary Suspension of Programs and Courses

LeftFoot Coaching, LLC is unable to temporary suspend any and all Programs and Courses and then resume it at a later date due to schedule and coaching resource planning for the Client.

 

Article 7. Acceptance of Use

Section 1.0 Description of Acceptance of Use

Regardless of plan access to the services that LeftFoot provides, you are subject to the following Terms of Use ("TOU"). LeftFoot reserves the right to update the TOU at any time without notice to you. The Terms of Use are Outlined Below.

Section 2.0 Terms of Use: General Information

Section 2.1 Disclaimer

In enrolling at LeftFoot Coaching, LLC, participant understands that he/she is attending the programs and using LeftFoot Coaching, LLC and the facilities does so at his/her own risk. Soccer is a physical sport with a significant risk of injury.  LeftFoot Coaching, LLC and its owners, employees or agents, shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by participant with his/her family in or about any programs on the premises. Participants and parents assume full responsibility for all injuries and damages which occur in or about any programs on the premises, He/She does hereby fully and forever release, discharge, and hold harmless LeftFoot Coaching, LLC, all associated facilities and its owner, employees, and agents from any and all claims, demands, damages or rights of action, present or future resulting from any person’s participation in any programs or use of the facility. 

Section 2.2 Session Reschedule / Cancellation Policy

I, the undersigned, do recognize that it is my sole responsibility to schedule, reschedule, late cancel and early cancel my student from all participation via the Front Desk support software. I cannot expect verbal, phone, email, or text communication with LeftFoot staff to be notice of non-attendance, scheduling requests or participation in any event. My “Upcoming Schedule” in Front Desk is my sole responsibility to manage and maintain to account for all future services and sessions. LeftFoot employees, interns and coaches are in no way responsible or held liable for phone, email, in person or text communications related to your students attendance. 

"Early Cancels" are cancellations more than 24 hours prior to the start of the session. These classes are retained and returned to my plan. "Late Cancels" are cancellations less than 24 hours prior to the session. These will be charged to my monthly allotment.

"No Shows" occur when a member fails to attend a session without notice to LeftFoot Coaching.  No-Shows will be charged to my monthly allotment. Penalty for No Shows: Two (2) no shows in a calendar quarter will cost me 2 sessions AND my future schedule will be deleted (requiring me to rebook all my sessions). Five (5) No Shows in the calendar year will result in my account being suspended without refund.

Section 2.3 Training Schedule Policy

LFC reserves the right to cancel any session no less than 4 hours before the class is scheduled. Students that have already scheduled a class that LFC is canceling will be notified by email. Any session cancelled by LeftFoot Coaching will be returned to the members’ monthly allotment.

LFC attempts to stay open during severe weather but understands that families may be prevented from attending sessions due to severe weather. Upon any National Weather Service declaration of dangerous weather, tornados, significant winter snow storms or other extreme conditions all cancellations or no-shows will be classified as "Reschedule-Early Cancel" without penalty. NWS must classify the storm as such to be declared a "reschedule." A company announcement will be posted on Facebook for customers and clients to see and this Facebook post serves as notice of extreme conditions.

Section 2.4 Sharing of Sessions or Services

LeftFoot “Fast-Pass” and Tuition Plans cannot be in any way shared between siblings or attended by Siblings under different names. For instance, Abby cannot attend Amy’s session or vice versa.

Section 2.5 Auto-Charge Account Permissions

I do hereby authorize LeftFoot Coaching Academy, LLC permission to auto-charge my account for drinks, t-shirts, equipment purchases and additional services upon signing a Product Purchase Form located in various areas of the Academy. The credit card on file from the trial or Membership Plan will be used. Snacks and drinks are auto-charged after they reach a $5 threshold or at the end of the membership cycle whichever is first. 

Section 2.6 Medical Consent

I, the undersigned parent or guardian/participant, do hereby grant authority to the staff at LeftFoot Coaching Academy, LLC to render a judgment concerning medical assistance or hospital care in the event of an accident or illness during my absence. In the event of an ongoing medical issue LeftFoot Coaching Academy has the authority to deny a player entry onto the field for a session.

Section 2.7 Image Consent

I do hereby authorize LeftFoot Coaching Academy, LLC to utilize any and all photographs, pictures or other likeness of me or anyone assigned guardianship to me, as they deem appropriate in its promotional materials or team films. 

Section 2.8 Public Non-Disclosure of Coaching Strategies

Parents, legal guardians, or volunteer coaches agree under any circumstance not to publicly disclose any coaching strategies, video tape or record sessions with any personal electronic devices, tactics employed in games, written coaching plans, session plans, technical recipes, handouts and books that are the confidential and exclusive rights of LeftFoot Coaching, LLC. Said patrons also agree not to take pictures or videos of instructors coaching their child or any other participants within a session.

Section 2.9 Wait-List Policy

Wait-list requests will only be accepted online through the Front Desk service platform.  Phone calls with wait-list requests will not be accepted. Wait-list requests from customers with an outstanding balance will not be accepted. Waitlists are managed by the coaches of the sessions and not through any administrative functions of the Academy. Each coach is responsible for managing requests, uploading attendance and fulfilling services. Coaches may or may not give anywhere from 24-72 hours of notice. However, if the client cannot attend the session within 24 hours of notice, a session will not be deducted from the Client’s plan or pass allotment. 

Section 2.10 Verbal Contracts and Scheduling Requests

In no circumstance are LeftFoot Coaching, LLC employees, coaches, and/or interns allowed to accept, declare, or promise any scheduling requests, billing issues, membership or tuition policies verbally, over the phone, without written record. All scheduling, billing and policy requests will directed through LeftFoot Enterprises, LLC and it’s FrontDesk support software. Clients are required to schedule themselves for ALL Academy Series, Semi-Private Coaching, and Tuition Courses. The only exception to this request is a solicitation of The LeftFoot Privado™ from the coach to the parent. Clients cannot request Late Cancels, Early Cancels, Scheduling, or Wait-lists requests verbally in person, via email, on the phone/voicemails, or text to any coach, intern or employee. Purchase Requests and documentation of any Coaching Services must, under every circumstance, be documented within a Zen Desk support software ticket. 

Section 2.11 Restructuring of Services by LeftFoot Coaching, LLC.

LeftFoot Coaching, LLC and its partners, coaches and employees reserve the right to restructure the Student Tuition Plan under any circumstances without refunds, exchanges, or account credit. In the event of a restructuring of services, a minimum of seven calendar days will be given in email notice to the clients’ scheduling agent.

Section 3.0 Terms of Use: Player Guidelines

Section 3.1 Behavior and Participation

All members agree to follow the rules of conduct and play set by LeftFoot Coaching Academy, LLC. Failure to do so may result in suspension or expulsion from participation. 

Section 3.2 No Club Wear in the Academy

We adamantly discourage the display of club wear and club affiliates in order to protect our students from cliques, bullying, judgment, harassment, and also recruiting by parents and other students. Students wearing club logos, practice jerseys, club tournament shirts or anything resembling club or team status or league standings will be asked to remove or turn their clothes inside out. Students refusing to change their clothes will be barred from participation in the Academy session without refunds, exchanges, or credits without exception. 

Section 3.3 No Cleats in the Academy

Turf or indoor shoes only. Not only is this LeftFoot’s turf, but it’s your turf too! Let’s take care of it. Not only does it make our field last longer, indoor footwear also makes it easier to learn more foot skills and techniques.

Section 3.4 Food and Beverages Policy

NO gum is allowed in or around the facility. No food or beverages on the field. Water is allowed during Semi-Private Coaching classes as long as tops of water bottles are sealed. Water and Gatorade access are only for active members and cannot be billed to guest or trial accounts. 

Section 3.5 No Big Kicks

No kicking pendulums, or big kicks towards the ceilings - Balls and pendulums could get stuck or damage the heating coils on the ceiling, thus disrupting sessions. Students and parents will be responsible for damages. 

Section 3.6 Do Not Interrupt Sessions in Progress

If you arrive early for your class, please wait in the designated areas until the current class finishes. Do not enter the field until all players exit the area and the coach instructs you to enter. 

Section 3.7 No Foul Language, Bullying, Negativity, or Recruiting

Our mission at LeftFoot Coaching Academy is to create a soccer “home” where students can learn, make mistakes, grow, and take their game to the next level in an environment where they can feel safe and free of judgment. The safety of our students whether physically, mentally, emotionally, or socially is our top priority, and any violation of this code of conduct will result in suspension or expulsion from the Academy. 

Section 3.8 Three Strikes Rule: Behavior and Exclusion

Players are given a THREE STRIKES RULE related to their behavior in Academy sessions. The THREE STRIKES are defined as a verbal warning related to distractions, unruly behavior, talking during coaching points and behavior whereby the coach must take extra time to address the player or group.

Section 3.8.1 First Strike

The FIRST STRIKE verbal warning is documented in the players’ Front Desk service platform for the parent to receive notice.

Section 3.8.2 Second Strike

The SECOND STRIKE allows the coach to remove the child from the session to wait for the parent to pick up from the session. There is no refund, exchange or credit for this session deemed by the coach to have resulted in significant distractions to the rest of the Academy to warrant removal from the coaching session. The parent is notified via the Front Desk service platform and recognizes that future behavior issues will result in immediate expulsion from the Academy.

Section 3.8.3 Third Strike

The THIRD STRIKE results in expulsion from the Academy and forfeiture of all services, contracts and fees immediately. 

Section 4.0 Terms of Use: Parent Guidelines

Section 4.1 No Crowding Around the Field

We provide a parent viewing area above the field so you can have the best angle of observation for your child’s class. Also, allowing yourself to be out of sight during their session will increase their focus, concentration, and effort with their coach rather than distract them by wondering who is watching them. 

Section 4.2 No Coaching From the Viewing Areas

Parents who coach from the sidelines while at LeftFoot Coaching Academy will be asked to leave the facility for the remainder of the class. Upon a second infraction parents will no longer be allowed in the primary field house. Expulsion from the Academy for both the parent and the student is within the actions reserved by LeftFoot Coaching Academy, LLC upon their judgment of the severity of behavior demonstrated by the parents.

Section 4.3 Promptness

Parents are expected to be prompt when dropping off or picking up their children and allow a few extra minutes for traffic. If you are unable to pick up your child on time you need to call the Academy as soon as possible to make the Coach aware. Three late shows will result in a late pick-up fee billed in 30 minute increments at the rate of the coaches private session fee.
